1. Agreement to Terms

By accessing or using Pivotify, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Pivotify, Inc. regarding your use of our job application tracking platform.

2. Description of Service

Pivotify is a subscription-based SaaS platform that provides job application tracking, AI-powered resume generation, and career tools for job seekers. Our services include:

  • Kanban-style job application tracking
  • AI-generated resumes and cover letters
  • LinkedIn profile optimization tools
  • Interview preparation resources
  • Salary negotiation guidance

3. Subscription and Billing

Pivotify operates on a subscription model with the following terms:

  • Pricing: $11 per week, billed on a recurring basis.
  • Free Trial: New users receive a 7-day free trial with no credit card required. At the end of the trial, you will be prompted to enter payment information to continue using the service.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial billing periods.
  • Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Price Changes: We reserve the right to modify subscription fees. Any price changes will take effect at the beginning of your next billing cycle, and we will provide advance notice.

4. User Accounts

To use Pivotify, you must create an account. You are responsible for:

  • Providing accurate and complete information during registration
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breaches

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

5. User-Generated Content

You retain full ownership of all content you create, upload, or store on Pivotify, including resumes, job application data, notes, and personal information. By using our services, you grant us a limited license to process and store your content solely for the purpose of providing our services to you.

You represent and warrant that:

  • You own or have the necessary rights to any content you submit
  • Your content does not violate any third-party rights, including intellectual property and privacy rights
  • Your content is accurate and not misleading

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Scraping: Using automated systems to extract data from our platform without authorization
  • Abuse: Harassing, threatening, or intimidating other users or our staff
  • Illegal Content: Uploading, sharing, or promoting illegal content or activities
  • System Interference: Attempting to disrupt, damage, or gain unauthorized access to our systems
  • Misrepresentation: Creating fake accounts or impersonating others
  • Commercial Exploitation: Reselling, sublicensing, or commercially exploiting our services without authorization

7. Intellectual Property

All content, features, and functionality of Pivotify, including but not limited to software, text, graphics, logos, and trademarks, are owned by Pivotify, Inc. and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our express written consent.

8. Disclaimer of Warranties

PIVOTIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Important: We do not guarantee job placement or employment outcomes. Our tools are designed to assist your job search, but success depends on many factors outside our control, including market conditions, your qualifications, and interview performance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIVOTIFY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF PIVOTIFY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the state and federal courts located in Delaware, and you consent to the exclusive jurisdiction of such courts.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of Pivotify after such changes constitutes acceptance of the revised terms.

12. Termination

We may terminate or suspend your access to Pivotify immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately, and we may delete your account data in accordance with our Privacy Policy.
